Premises liability is an area of personal injury where a person is injured while
on another party's property. If you were injured at someone else's home or a
commercial establishment, the person or entity responsible for the premises may

the party in control of the property. That party is responsible for the care,

known, about the dangerous condition; and (3) the owner had a reasonable
opportunity to correct or warn of the condition, which was not reasonably open
and obvious to the injured party at the time of the accident. In general, it is
the duty of an owner to exercise reasonable care in the maintenance of the
premises.
A premises liability injury is caused by the negligent management or control of
the premises by the property owner or operator, and may occur in a variety of
locations, including a residence, school, shopping mall, or grocery store. In
the state of Texas the owner or operator of a property is legally responsible
for the safety of others while on the property. This includes residents,
visitors, employees, and other individuals on the property.

unsafe surface that should have been properly maintained by the defendant.
